Public Healthcare & the NLV
Spanish Public Healthcare and the NLV
NLV holders don’t join the public system through work. Here is how eligibility is assessed, the routes that exist, and how health cover fits your visa.
Two Systems
Public Healthcare and Private Health Insurance in Spain
Spain has a public national health system, run by each region, and private health insurers. Most people who work in Spain join the public system through social security. NLV holders don’t work in Spain, and the visa requires evidence of qualifying health cover — so access to the public system isn’t automatic.
Ley 16/2003, art. 3.2.c gives public healthcare to foreign nationals with legal and habitual residence in Spain who aren’t obliged to prove health cover by another route. Because the NLV requires evidence of health cover, whether you qualify under that rule depends on your circumstances. Recognition is handled by the Ministry of Health with the regional health services (art. 3 bis) — ask yours, and never drop your private policy on the strength of an expected entitlement.
Who Can Register
How NLV Holders Can Reach the Public System
Convenio especial
For people with no other entitlement: after at least a year of continuous residence, with padrón registration in the region (RD 576/2013, art. 3). €60 a month under 65; €157 at 65 or over.
Pension-state cover (S1)
If your pension country covers your healthcare under EU or bilateral social security rules — for example with an S1, registered through the INSS — you have access through that route, and the convenio isn’t available to you.
Residence-based entitlement
Legal residents who aren’t obliged to prove cover by another route are entitled (Ley 16/2003, art. 3.2.c). For NLV holders this is assessed individually — check with your regional health service.
Practical Steps
Setting Up Your Healthcare in Spain
In order
- Before you apply: arrange evidence of qualifying health cover — an eligible registered S1 may satisfy your consulate’s requirements; otherwise, suitable insurance with a certificate for your file. Check your consulate’s current checklist
- When you arrive: register on the padrón at your town hall — you need it for the convenio and many local services
- Keep cover continuous: your renewal checks that health insurance was maintained throughout your permit
- After a year: if you’re considering the convenio especial, apply to your regional health service — and confirm with your immigration office how it treats it before changing anything
Each region publishes its own convenio form and procedure. How the convenio especial works, step by step →
Choosing Cover
Choosing Suitable Cover
Cover throughout Spain
A policy for the NLV needs to cover you throughout Spain with no copayments for covered services, with a certificate for your file.
Cover when you travel
If you’ll spend time outside Spain, ask about cover abroad. It varies between policies, and your quote sets out what applies.
Your age and health
Eligibility, terms and any exclusions are confirmed for each person when you apply.
Everyone named
On a family application, each person is insured and named on the certificate.

Common Questions
Questions We Hear Every Day
Can NLV holders use Spanish public healthcare?
It depends on your circumstances. Ley 16/2003, art. 3.2.c gives public healthcare to foreign nationals with legal and habitual residence who aren’t obliged to prove health cover by another route — and the NLV itself requires evidence of health cover, so eligibility has to be assessed case by case. You don’t join through work, because the NLV doesn’t allow it. Other routes include cover from a pension country (for example an S1) and, for people with no entitlement, the paid convenio especial after a year of residence.
What is the convenio especial?
A paid agreement with the regional health service giving access to the public system’s basic services, under Real Decreto 576/2013. It costs €60 a month under 65 and €157 at 65 or over.
Can I use the public system for my first NLV application?
Your NLV application needs evidence of qualifying health cover. An eligible registered S1 may satisfy your consulate’s requirements; otherwise, arrange suitable insurance. Check your consulate’s current checklist. The convenio especial isn’t an option for a first application, because it needs a year of residence.
Can the convenio especial replace my private policy at renewal?
The renewal rules (RD 1155/2024, art. 64.2.c) require health insurance to be maintained and continued, but don’t say whether the convenio satisfies this. Confirm how your Oficina de Extranjería treats it before cancelling any policy, and never leave a gap.
